Does New Mexico follow the federal rule?
New Mexico uses "rolling" (current) conformity: its income tax code follows the Internal Revenue Code as it currently stands, not a fixed historical date. A federal change — including §530A, added by the One Big Beautiful Bill Act (OBBBA, Public Law 119-21, enacted July 4, 2025) — applies for New Mexico income tax purposes the same way it does federally, without the legislature needing to act separately, unless New Mexico has specifically decoupled from that provision.
What this means for a Trump Account in New Mexico
Based on that mechanism, New Mexico currently follows the federal §530A treatment: contributions and growth are not separately taxed by the state before distribution, the same deferral the federal rule provides. Separately from its general conformity mechanism, New Mexico has taken its own action specific to Trump Accounts/§530A: SB 151 (signed ~March 11, 2026) decouples only the corporate income tax base from certain OBBBA provisions (bonus depreciation, the §163(j) interest limitation, GILTI/NCTI-style income); it does not touch personal income tax conformity and does not mention Trump Accounts or §530A.
