Trump Accounts in Maine: State Tax Treatment

Whether Maine taxes a Trump Account's growth and distributions the way the IRS does — checked against Maine's own conformity law, not a national summary.
Does Maine follow the federal rule?
Maine uses "fixed-date" (static) conformity: its tax code names a specific historical IRC date rather than following current federal law automatically. Its conformity date is December 31, 2025. That date is on or after OBBBA's July 4, 2025 enactment, so Maine's general conformity picks up §530A as part of the Code it already follows.
What this means for a Trump Account in Maine
Based on that mechanism, Maine currently follows the federal §530A treatment: contributions and growth are not separately taxed by the state before distribution, the same deferral the federal rule provides. Separately from its general conformity mechanism, Maine has taken its own action specific to Trump Accounts/§530A: P.L. 2025, ch. 650 (LD 2212/H.P. 1491), approved by the Governor April 10, 2026, amended 36 M.R.S. § 111(1-A) to move Maine's IRC conformity date from December 31, 2024 to December 31, 2025, applicable to tax years beginning on or after January 1, 2025, and expressly ties the update to federal Public Law 119-21 (OBBBA) by name. The Act separately decouples from specific other OBBBA provisions (domestic research-expensing under § 174A, bonus depreciation for qualified production property under § 168(n), the GILTI-to-NCTI relabeling, opportunity zones under § 1400Z-2, and the QSBS gain exclusion under § 1202) but does not decouple from § 530A.
A note on this determination
Maine's own code revisor had not yet updated the codified text of 36 M.R.S. § 111(1-A) at the time of this verification — it still showed the pre-amendment "December 31, 2024" date, a normal and expected lag between an enacted chapter law and its eventual codification. The quote and conformity date above come directly from the enacted chapter law itself (P.L. 2025, ch. 650, Sec. K-1), not the lagging codified page. The new date postdates OBBBA's July 4, 2025 enactment, and the Act's application clause (Sec. K-27) explicitly ties the update to federal Public Law 119-21 by name. § 530A is not among the handful of provisions the Act separately decouples from, so Maine captures Trump Account treatment through its general conformity mechanism.
